When a Directive Takes Effect Under Delaware Law
Your advance health care directive becomes operative when a qualified health care professional determines you lack the capacity to make your own medical decisions. Until that threshold is met, the document has no effect on your day-to-day care.
Completing one is voluntary, but going without one has real consequences. Under Delaware’s Uniform Health-Care Decisions Act, a statutory surrogate hierarchy determines who speaks for you if no directive is in place: starting with your spouse or domestic partner, then an adult child or parent, then a cohabitant, then an adult sibling, and down the line from there. That hierarchy may not reflect your actual wishes or your family’s dynamics. One more distinction worth noting: a living will directs medical care during your lifetime when you’re incapacitated. A last will and testament governs how your property is distributed after death. They serve entirely different purposes.
The Structure of Delaware’s Advance Health Care Directive Form
Delaware’s Advance Health Care Directive Form is organized into several parts under the state’s Uniform Health-Care Decisions Act, each covering a distinct topic.
Part A: Naming an Agent
Here you name a healthcare agent and an alternate agent. The agent’s authority activates when a qualified health care professional determines you lack decision-making capacity. This Power of Attorney for Health Care is distinct from a Durable Financial Power of Attorney, which covers financial matters. One doesn’t substitute for the other.
Part B: Health-Care Instructions
This section lets you state your preferences about life-sustaining treatment, food and liquids, pain relief, and other care priorities. These instructions can stand on their own even if you don’t complete the rest of the form.
Part D: Organ Donation
Optional. Allows you to designate organ and tissue donations to take effect upon death.
Execution Requirements: Getting the Witness Rule Right
Delaware doesn’t require notarization for an advance health care directive to be valid, but the witness requirements are specific. Improper witnessing is the most common basis for challenging a directive’s validity.
Under Delaware’s Uniform Health-Care Decisions Act, a witness can’t be the agent you’ve named, or that agent’s spouse, domestic partner, or cohabitant. If you reside or receive care in a nursing home or long-term care facility, the witness can’t be an owner, operator, employee, or contractor of that facility.
After signing, provide copies to your primary physician, your named healthcare agent, and any family members who may need to act on the document. Where you keep the original matters as much as having it drafted correctly.
